Terms of Service for DriftPulse

Please read these Terms of Service ("Terms") carefully before using the DriftPulse mobile application ("Service") operated by DriftPulse ("us", "we", or "our").

Acceptance of Terms

By accessing or using DriftPulse, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

Description of Service

DriftPulse is a mobile application that allows users to:

• Record GPS and motion data during drift racing sessions
• Visualize drift sessions in 3D replay mode
• Share drift content with other users
• Manage drift session logs and statistics

User Accounts

Registration

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must be at least 13 years old to use the Service
• One person may not maintain multiple accounts

Account Termination

• You may delete your account at any time through the app
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your access to paid features will cease

Subscriptions and Payments

Auto-Renewable Subscriptions

DriftPulse offers the following subscription options:

Payment Terms

• Payment will be charged to your iTunes Account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period
• Account will be charged for renewal within 24-hours prior to the end of the current period
• The cost of renewal will be the same as the original subscription price
• Subscriptions may be managed by you and auto-renewal may be turned off by going to your Account Settings after purchase
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication

Refund Policy

• All purchases are final and non-refundable except where required by law
• Refund requests should be directed to Apple through iTunes/App Store
• We do not have access to process refunds directly

Free Trial

• If a free trial is offered, it will be clearly disclosed before purchase
• You may cancel during the free trial period without being charged
• After the trial period ends, you will be automatically charged unless you cancel

Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• You will retain access to premium features until the subscription expires
• No partial refunds for unused time

To cancel:

1. iOS: Settings → [Your Name] → Subscriptions → DriftPulse → Cancel Subscription
2. In-app: Profile → Manage Subscription → Cancel

Free Tier Limitations

Free users have access to:

• Basic drift session recording
• Limited log storage (10 sessions maximum)
• 2D map replay
• Basic social features

Free users do NOT have access to:

• Unlimited log storage
• Advanced analytics
• Tandem partner synchronization
• 3D replay with premium features

User Content

Your Content

• You retain all rights to the drift session data you create
• By using social features, you grant us a license to display your shared content
• You are responsible for ensuring you have rights to any content you upload
• Do not upload content that infringes on others' intellectual property

Prohibited Content

You may not post content that:

• Violates any law or regulation
• Infringes on intellectual property rights
• Contains malicious code or viruses
• Harasses, threatens, or discriminates against others
• Promotes illegal activities
• Contains explicit or inappropriate material

Content Removal

• We reserve the right to remove content that violates these Terms
• Repeated violations may result in account suspension or termination

Use Restrictions

Prohibited Activities

You may not:

• Use the app for any illegal purpose
• Reverse engineer, decompile, or disassemble the app
• Circumvent subscription or payment mechanisms
• Use automated systems (bots) to access the Service
• Collect user data without permission
• Impersonate others or provide false information
• Interfere with or disrupt the Service
• Use the app while driving (recording must be done by passenger or after driving)

Intellectual Property

Our Rights

• DriftPulse name, logo, and app design are our intellectual property
• You may not use our trademarks without written permission
• The app and its content are protected by copyright laws

License to Use

• We grant you a limited, non-exclusive, non-transferable license to use the app
• This license does not include rights to resell or commercial use
• The license terminates if you violate these Terms

Third-Party Services

DriftPulse integrates with:

• Firebase (Google) - Cloud services
• Apple Services - Payments and authentication

These services have their own terms and privacy policies. Your use of DriftPulse constitutes acceptance of their terms as well.

Data and Privacy

• Your use of DriftPulse is also governed by our Privacy Policy
• We collect and use data as described in the Privacy Policy
• By using the Service, you consent to data collection as outlined

Disclaimers

"AS IS" Basis

• The Service is provided "as is" without warranties of any kind
• We do not guarantee the Service will be uninterrupted or error-free
• We do not warrant the accuracy of GPS or motion data
• Use of the app is at your own risk

No Professional Advice

• DriftPulse is for entertainment and personal use
• It does not provide professional driving instruction
• Consult professionals for racing training

GPS Accuracy

• GPS accuracy depends on device hardware and environmental factors
• We cannot guarantee precise location tracking in all conditions
• Data should not be used for legal or official purposes

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for subscriptions in the past 12 months
• This includes damages from data loss, service interruption, or any other cause
• We are not responsible for accidents or injuries resulting from app use

Indemnification

You agree to indemnify and hold us harmless from:

• Any claims resulting from your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any illegal activities conducted using the app

Changes to Terms

• We may modify these Terms at any time
• Material changes will be notified through the app
• Continued use after changes constitutes acceptance
• You should review Terms periodically

Termination

By You

• You may stop using the Service and delete your account at any time

By Us

We may terminate or suspend your account if:

• You violate these Terms
• You engage in fraudulent activity
• Required by law
• We discontinue the Service

Upon termination:

• Your access to premium features ends immediately
• No refunds for unused subscription time
• Your data may be deleted after 30 days
